Dentorion Oral and Dental Health Polyclinic Information Notice on the Protection and Processing of Personal Data

As Dentorion Ağız Diş Estetik Merkezi Ltd. Şti. (Dentorion and/or Dentorion Oral and Dental Health Polyclinic, for short), pursuant to the Personal Data Protection Law No. 6698, we carry out, within the scope of the KVKK and secondary legislation, the responsibility for the collection, purpose of use, processing, transfer and retention period of the personal data of our patients and/or their legal representatives, persons or representatives of companies or organizations who contact us, our business partners, our employees and those who interact with us by applying for a job or visiting our website, as well as data confidentiality and protection activities.

To this end, we take security measures and inform you about your rights; we attach great importance to the security of your personal data. We keep all personal data shared by our patients in a way that respects patient privacy and with all necessary technical and administrative measures to ensure an appropriate level of security for your personal data.

This Notice on the Protection of Personal Data explains our personal data protection and processing policy and how we, as Data Controller, collect, use, transfer and protect your personal data while providing our services.

1. COLLECTION AND PROCESSING OF PERSONAL DATA AND PURPOSES OF PROCESSING

As Dentorion Oral and Dental Health Polyclinic, we process and retain your personal data in accordance with Article 20 of the Constitution, the principles in Article 4 of the Personal Data Protection Law and the provisions of secondary legislation. Your personal data is collected so that healthcare services can be provided within the legal framework and so that Dentorion can fully and properly fulfill its contractual and other legal obligations in this context, and it is retained for 40 years, as stipulated by law or required by the purpose of processing.

Depending on the healthcare services provided, personal data is collected verbally, in writing or electronically, by automated or non-automated means, through the call center, the website, online services, WhatsApp and similar channels.

Your Personal Data;

General and special categories of personal data may be processed with the explicit consent of the data subject and in the cases set out in Articles 5 and 6 of the KVKK. In line with the relevant legislation and the principles in this information notice, and in accordance with Dentorion's Policy on the Protection, Confidentiality and Destruction of Personal Data, the following types of data may be processed by Dentorion:

Your Personal Data;

Your name, surname, Turkish ID number, passport number or temporary ID number, place and date of birth, marital status, gender, the contents of the patient file created by our clinic and other identity data by which we can identify you; your address, phone number, e-mail address and other contact data; financial data such as payment, credit card, bank and billing information; audio and/or digital information obtained by us at various times by electronic or non-electronic means; video and/or audio camera recordings obtained or that may be obtained during your visit to our clinic; your general and special categories of personal data, in particular personal health data obtained during all medical diagnosis, examination, treatment and care services; your private health insurance data and Social Security Institution data; health and identity data sent through our website; and financial data such as payment and billing information — including but not limited to these, the necessary data will be processed by our clinic. Your personal data will be processed within the personal data processing conditions and purposes set out in Articles 5 and 6 of the KVKK. Your special categories of personal data, in particular your health data, and your general personal data may be processed by our clinic for the following purposes;

Your personal data, including special categories of personal data, may be processed for purposes such as;

Fulfilling our legal obligations under the Basic Law on Health Services No. 3359, the Decree Law on the Organization and Duties of the Ministry of Health and its Affiliated Institutions, the Regulation on Private Hospitals, the Regulation on the Processing of Personal Health Data and Ensuring Privacy and other related regulations,
Protecting public health, preventive medicine, and carrying out medical diagnosis, treatment and care services,
Planning healthcare services and their financing,
Billing for our services,
Sharing requested information with private insurance companies within the scope of financing healthcare services,
Financial reconciliation with contracted institutions regarding the healthcare services provided to you;
Informing you about your appointment if you make one,
Sending campaigns and information by message, e-mail or other means,
Planning the internal operations of our clinic,
Monitoring and preventing abuse and/or unauthorized transactions,
Conducting scientific research,
Responding to all your questions and complaints regarding our healthcare services,
Taking all necessary technical and administrative measures for the data security of our clinic's systems and applications,
Analyzing your use of healthcare services in order to develop and improve the healthcare services we provide, and storing your health data and retaining information on health data that must be kept under the relevant legislation,
Measuring patient satisfaction, including but not limited to these and similar purposes.

In addition, your personal data may be processed within the framework of the Basic Law on Health Services No. 3359, Decree Law No. 663 on the Organization and Duties of the Ministry of Health and its Affiliated Institutions, the Private Hospitals Law and Regulation, the Regulation on the Processing of Personal Health Data and Protection of Privacy, Ministry of Health regulations and other legislation, and may be kept in both digital and physical form by being transferred to physical archives and IT systems belonging to Dentorion Oral and Dental Health Polyclinic and/or our suppliers. Furthermore, the data of our clinic employees may be processed by us or by the real or legal persons we cooperate with or authorize, within the scope of the obligations stipulated by the Labor Law, Labor and Social Security Legislation and other legislation in force, for operational reasons such as increasing employee satisfaction and ensuring occupational safety and workplace harmony, in accordance with the employer's right of management.

2. PERSONS AND ORGANIZATIONS TO WHOM YOUR PERSONAL DATA MAY BE TRANSFERRED

Your personal data may be transferred, within the scope of the Law and similar legislation and for the purposes stated above, to:

The Ministry of Health and its affiliated units, Family Health Centers,
The Social Security Institution,
Private insurance companies (health, pension, life insurance and similar)
The General Directorate of Security and similar law enforcement agencies,
The Civil Registry Directorate,
The Turkish Pharmacists' Association,
The Turkish Chamber of Dentists,
Chief Public Prosecutor's Offices, courts, arbitrator(s) in arbitration proceedings,
Laboratories, centers and similar third parties we cooperate with for medical diagnosis,
Representatives you have authorized,
The healthcare institution to which the patient is referred or which the patient applies to,
Third parties we consult, including lawyers, tax advisors and auditors,
Regulatory and supervisory authorities, official bodies
Our suppliers, support service providers, business partners and other third parties whose services we use or with whom we cooperate, within the personal data processing conditions and purposes set out in Articles 8 and 9 of the KVKK

3. METHOD AND LEGAL BASIS OF PERSONAL DATA COLLECTION

Your personal data is collected through all kinds of verbal, written or electronic channels, for the purposes stated above, so that healthcare services can be provided within the established legal framework and so that Dentorion can fully and properly fulfill its contractual and legal obligations in this context, in accordance with the principles set out in the KVKK.

4. DATA SECURITY

Your personal data is protected in full compliance with all technical and administrative security controls required by information security standards and procedures. These security measures are provided at a level appropriate to the potential risk, taking technological possibilities into account.

5. YOUR RIGHTS REGARDING THE PROTECTION OF PERSONAL DATA

With regard to your processed personal data, under the legislation you have the right to:

Learn whether your personal data is processed and, if so, request information about it,
Access and request your personal health data, and learn the purpose of processing and whether it is used in accordance with that purpose,
Know the third parties in Turkey or abroad to whom your personal data is transferred,
Request the correction of personal data that is incomplete or inaccurate, and request the deletion or destruction of personal data,
Request that the third parties to whom your personal data has been transferred be notified of the correction of incomplete or inaccurate data and/or of the deletion or destruction of personal data,
Object to any outcome against you resulting from the analysis of processed data exclusively by automated systems,
Request compensation for damages if you suffer harm due to the unlawful processing of your personal data.

Pursuant to paragraph 2 of Article 13 of the KVKK, your applications submitted to us will be answered within thirty days from the date your request reaches us, depending on the nature of the request; pursuant to the relevant provision of Article 13 of the KVKK, our responses will be delivered to you in writing or electronically.

We protect your personal data in accordance with the legal regulations required by law. Our clinic has taken administrative and technical security measures to protect your personal data and will continue to do so. You can submit your requests under the Law by filling in the Application Form on www.dentorion.com and delivering it by hand or sending it via a notary to Dr. Mustafa Enver Bey Cd. No:1/1 Berki Apt.
